Korein Tillery, a leading national law firm specializing in complex litigation, has successfully secured final approval for a $49.25 million settlement in a class action lawsuit on behalf of NCAA baseball coaches. This landmark agreement, which was deemed an “exceptional result” by the federal judge approving of it, resolves antitrust claims involving compensation practices for former “volunteer” baseball coaches. It offers significant financial relief to affected coaches and reinforces the importance of fair pay in the industry. While the payouts will vary, class members are expected to, on average, receive close to $50,000 each.
The settlement stems from allegations that the NCAA and its member institutions conspired to limit the compensation of assistant coaches in Division I baseball programs. The lawsuit contended that the NCAA’s policies and agreements suppressed the coaches' salaries in violation of antitrust laws.
“This settlement provides over 90% of the alleged damages, which is an outstanding result in any case, and certainly in an antitrust case,” said Garrett Broshuis, Partner at Korein Tillery. “Our clients faced significant barriers to fair pay in a system that has long profited from their expertise and hard work. This settlement represents a victory for fairness and accountability in college athletics.”
The case was filed in November 2022. Just four months later, the NCAA rescinded the bylaw allowing for volunteer college baseball coaches.
Korein Tillery has a long history of success in antitrust litigation and in sports law, and has been at the forefront of advocating for fairness and equal treatment in the sports industry. Korein Tillery attorneys leading the case include Garrett Broshuis and Steve Berezney.
The case is Smart v. Nat’l Collegiate Athletic Ass’n, No. 2:22-cv-02125 (E.D. Cal.). A copy of the opinion can be downloaded here:
